Terms & Conditions

Getting Started

Once we have finalized a design Benham Design Concepts requires a 50% deposit to start the project. Depending on the scope of the project I will specify either the balance be paid in full upon completion and prior to delivery of the project, or progress payments be made upon percent of project completed and any additional costs added do to design changes.

Changing or cancelling your order

If you wish for any reason to cancel your order, you must notify Benham Design Concepts in writing, within 3 days of the original order date. If Benham Design Concepts is given notice of a cancellation within 3 days of the original order date, a refund will be issued in the same tender as your deposit payment. However, if your order has been started by Benham Design Concepts or if materials have been purchased specifically for the project, all material and labor expenses at current shop hourly rate of $65.00 an hr will be deducted from the deposit payment. Once Benham Design Concepts start a custom projects we order materials and produce a cut list based on the current furniture design. If the design evolves in scope, details, or work required beyond the original agreed upon design, additional charges may be assessed to encompass the materials and additional work required to revamp and build the design.

Approvals, delays, and on-site limitations

Customer must carefully review and approve any written descriptions, drawings or finish samples if normally provided for the product they are purchasing. All products will be made to these specifications; the customer is responsible for approving of design and or samples in a timely manner. All lead times quoted are close approximations of the production time required for any given design to ship point. Delays in production time may be caused by slow approval of project drawings or finish samples by customer, unforeseen complications with availability of materials, schedules of any sub contractors, design limitations, etc. and Benham Design Concepts cannot be held responsible for delays beyond its control.

Storage & late balance due

Once a project is ready to ship, the client is notified accordingly. We encourage our clients to inspect their completed projects at the Benham Design Concepts Studio, as we require final payment before delivery. If a client cannot or chooses not to inspect the furniture at the Benham Design Concepts Studio before shipping, the furniture will be deemed "inspected and approved". In no case, shall Benham Design Concepts be responsible for any problems discovered after delivery or any return shipping charges. After 30 days of being notified the project is ready to ship, storage charges will accrue at a rate of .05% of the value of the item per day. Items will be stored at client's own risk. After 30 days, past due balance invoices shall accrue 1.5% monthly interest (18% per annum). After 30 days from notification of completion, if customer is unable to or unwilling to accept shipment of item, Benham Design Concepts will have the option to pursue whatever actions deemed necessary to remedy the situation and be compensated for any outstanding balances and storage charges.

Product liability

Benham Design Concepts cannot be held responsible for any injury, harm or possible death that might occur with the proper or improper use of these products. Neither can Benham Design Concepts be responsible for products; such as, but not limited to, wear and tear, expansion and contraction of woods and joinery due to climatic changes, limitation of finish materials in any given situation, choice of materials or design chosen by designer or client, buyer's remorse or any other liability whatsoever resulting from use of the products.

Returning your order

As many of our products are either custom built to a client's needs or fabricated upon order, all sales are final. If you are not completely satisfied with your purchase please notify Benham Design Concepts and we will do everything possible and within reason to help resolve the problem.

Showcasing your designs

Unless otherwise requested and agreed upon, Benham Design Concepts may choose to showcase your designs on its website as examples of Custom Furniture Designs that we have made in the past and also offer for sale new versions of these designs to other clients. We always give the original designer if not designed by Benham Design Concepts acknowledgement for their design.

Finalizing Terms and Conditions

Final terms and conditions may be revised by Benham Design Concepts to suite each projects special circumstances. Benham Design Concepts reserves the right to revise the above terms and conditions at any time without notice.
